At The Baking Sweetness, we produce fresh, made-to-order artisan products that are considered perishable goods. Due to the nature of our products, we do not accept returns or issue refunds once an order has been prepared, shipped, or delivered, except in the limited cases expressly outlined in this policy.
By placing an order, the customer acknowledges and agrees to this Refund Policy in its entirety.
1. PERISHABLE PRODUCTS – NON-REFUNDABLE
All of our products are fresh, custom-made food items. For food safety, hygiene, and quality control reasons, all sales are final. Refunds or returns will not be issued for:
✔ Change of mind
✔ Taste or texture preferences
✔ Carrier delays
✔ Minor cosmetic damage during transit
✔ Orders marked as “Delivered” by the carrier
✔ Customer errors when entering the shipping address
✔ Recipient absence at the time of delivery
2. RIGHT OF WITHDRAWAL
The right of withdrawal or post-purchase cancellation does NOT apply to our products, as they are:
✔ Goods that may spoil or expire quickly
✔ Made-to-order products
✔ Sealed food items for hygiene reasons
This is consistent with consumer protection regulations applicable to perishable and prepared food products.
3. ISSUES – LIMITED EXCEPTIONS
Exceptions will only be evaluated in the following cases:
✔ Incorrect product (verifiable error on our part)
✔ Product damaged due to inadequate packaging attributable to us
✔ Order not matching the purchase confirmation
The customer must contact us within forty-eight (48) business hours from delivery, excluding weekends and non-business days, and provide:
✔ Order number
✔ Clear photographs of the product
✔ Photographs of the packaging and shipping label
✔ Detailed description of the issue
⚠️ Claims submitted outside the stated timeframe or without photographic evidence will not be considered under any circumstances.
After review, at our sole and exclusive discretion, we may offer:
✔ Replacement of the product at no cost, or
✔ A store credit voucher for the corresponding amount
Monetary refunds are not guaranteed. If replacement is not possible, the matter will be handled in accordance with applicable law. The product and its original packaging must be retained until further instructions are provided.
4. CANCELLATIONS
✔ Orders may only be canceled before preparation begins.
✔ Once production has started, orders cannot be canceled or modified, including flavors, designs, or quantities.
✔ Customized orders are not cancelable under any circumstances once started.
5. DELIVERY AND ADDRESSES
✔ If delivery cannot be completed due to:
✔ Incorrect or incomplete address
✔ Typographical errors by the customer
✔ Repeated recipient absence
✔ Package refusal
❌ No refund will be issued. A new delivery attempt may be arranged, subject to additional shipping costs, which must be covered by the customer.
6. CARRIER RESPONSIBILITY
Once the order is handed over to the carrier (UPS, USPS, or others), responsibility for delivery times, delays, losses, or delivery errors rests exclusively with the carrier. We do not offer refunds or replacements for:
✔ Weather-related delays
✔ High shipping volumes during holiday seasons
✔ GPS or routing errors
✔ Package theft after confirmed delivery
7. PRODUCT STORAGE AND HANDLING
The customer is responsible for following the provided storage and handling instructions. We assume no responsibility for:
✔ Product deterioration after delivery
✔ Improper storage
✔ Improper handling of the product
8. LIMITATION OF LIABILITY
Under no circumstances shall The Baking Sweetness be liable for:
* Indirect, incidental, special, or consequential damages
* Economic, commercial, reputational, or emotional losses
* Loss of income, events, celebrations, or customer expectations
* Third-party claims
* Bank disputes, chargebacks, or payment platform claims arising from non-compliance with this policy
Any liability, if established, shall not exceed the total amount actually paid for the specific order giving rise to the claim. The customer agrees that this policy constitutes the sole and exclusive method for resolving any dispute related to refunds, returns, or dissatisfaction, and expressly waives additional claims, legal actions, or malicious reviews based on situations covered by this policy.
9. EXCLUSIVE REMEDY
The customer agrees that any claim, dispute, or dissatisfaction related to an order placed with The Baking Sweetness shall be resolved exclusively in accordance with this Refund Policy. If a valid claim is approved, the sole and exclusive remedy shall be, at the discretion of The Baking Sweetness, either product replacement or store credit, and not a monetary refund, unless expressly required by applicable law.
10. ARBITRATION AND DISPUTE RESOLUTION
Any dispute, claim, or controversy arising from the purchase of products from The Baking Sweetness that cannot be resolved amicably shall be resolved through binding arbitration, and not through individual or class-action lawsuits, to the extent permitted by law. Arbitration shall be conducted in accordance with applicable commercial arbitration rules in the State of Florida, with the venue being Miami-Dade County, Florida. The customer agrees not to participate in class actions related to purchases, refunds, or disputes covered by this policy.
12. REVIEWS, COMMUNICATIONS, AND GOOD FAITH
The Baking Sweetness respects the customer’s right to express honest opinions. However, the customer agrees not to publish or disseminate false, misleading, defamatory, or bad-faith reviews or communications, including those based on matters clearly governed and resolved under this policy. In the event of false or malicious publications, The Baking Sweetness reserves the right to request correction or removal and to pursue any legal remedies permitted by law.
13. GOVERNING LAW AND JURISDICTION
This Refund Policy shall be governed by and interpreted in accordance with the laws of the State of Florida, United States. To the extent any dispute is not subject to arbitration under this policy, the parties agree that any legal action shall be brought exclusively in the courts located in Miami-Dade County, Florida.
14. ACCEPTANCE OF THE POLICY
By placing an order through our website, social media, phone, or any sales channel, the customer:
